Terms of Service

1. Service Description

vCard.ee provides digital business card creation and management services. Our platform allows users to create, manage, and share digital business cards for their companies and employees.

2. User Accounts and Registration

2.1. Users can register from any country worldwide.

2.2. Users must provide accurate and complete information during registration.

2.3. Users are responsible for maintaining the confidentiality of their account credentials.

3. Subscription Plans and Payments

3.1. Subscription Plans

Free Plan:

• 1 Business Card
• 1 Company
• Basic Support – Not included
• Custom Branding – Not included
• Custom QR-code – Not included
• Email Signature Generator – Not included
• Statistics – Not included
• Includes vCard.ee copyright branding

Free Trial:

• Activated automatically upon registration
• Includes 1 Company and 1 Business Card
• Full access to all paid features for 1 month
• After 1 month, access to premium features is removed
• Custom settings are reset to default
• Upgrading to a paid plan restores full access
• Includes vCard.ee copyright branding

Basic Plan:

• 15 Business Cards
• 1 Company
• Basic Support – Included
• Custom Branding – Not included
• Custom QR-code – Not included
• Email Signature Generator – Not included
• Statistics – Not included

Premium Plan:

• 45 Business Cards
• 3 Companies
• Premium Support – Included
• Custom Branding – Included
• Custom QR-code – Included
• Email Signature Generator – Not included
• Statistics – Not included

Advanced Plan:

• 100 Business Cards
• 5 Companies
• Premium Support – Included
• Custom Branding – Included
• Custom QR-code – Included

3.2. Payment Terms

• All payments are securely processed through Stripe
• Prices are displayed in euros (EUR)
• No VAT (Value Added Tax) is applied, as the service provider is not VAT-liable
• Stripe is responsible for handling and processing payment transactions according to PSD2 and international standards

3.3. Failed Payments

• In case of payment failure, the account will automatically revert to the Free plan
• Users retain access to basic features included in the Free plan
• Premium features will be suspended until payment issues are resolved
• No data will be deleted due to payment failure

3.4. Force Majeure

We shall not be held liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, government actions, power outages, cyberattacks, labor strikes, or third-party service disruptions. In such cases, we reserve the right to:

• Suspend or modify services as needed
• Extend delivery or service timelines without liability
• Cancel obligations without penalty

By continuing to use our services, you acknowledge and accept that no compensation, refund, or legal claim shall arise from such interruptions or delays.

3.5. Changing or Cancelling Subscription

All subscription management actions can be performed in the Subscription → Manage Subscription section within your account.

• Upgrading to a higher plan takes effect immediately. The new features and limits will become available as soon as the upgrade is confirmed and payment is processed.
• Downgrading to a lower plan will take effect at the start of the next billing cycle. Until then, the user will retain access to the current plan''s features.
• Cancellation of subscription does not take immediate effect. The subscription remains active for the rest of the already-paid billing period, after which access to paid features will be suspended, and the account will revert to the Free plan.
• No refunds are issued for early cancellation or downgrading. All payments are final and non-refundable, even if the paid plan is terminated before the end of the billing period.

4. Account Termination and Data Deletion

4.1. Account Deletion Process

Upon account deletion request, the following data will be permanently removed:

• All personal and company information
• All business cards and associated data
• Payment history and transaction records
• All user-generated content and settings

Important: This deletion is permanent and irreversible. No data can be recovered after deletion.

5. Data Protection and Privacy

5.1. We comply with:

• Estonian Personal Data Protection Act
• General Data Protection Regulation (GDPR)
• Estonian Electronic Communications Act

5.2. All user data is stored on secure servers hosted by Contabo GmbH, located in Germany (EU), and managed in accordance with EU data protection regulations.

5.3. Payment processing is handled by Stripe, which acts as the data controller for payment-related information. We do not store full payment details on our servers.

5.4. Users consent to their data being processed and stored by our infrastructure providers solely for the purpose of providing and improving the service.

6. Service Limitations and Modifications

6.1. We reserve the right to:

• Modify service features and pricing with appropriate notice
• Suspend services for maintenance or updates
• Terminate services to users violating these terms

7. Intellectual Property

7.1. Users retain rights to their content while granting us license to:

• Display and process their content for service provision
• Store and backup data as needed for service operation

8. Liability and Disclaimers

8.1. Our liability is limited according to Estonian law.

8.2. We are not liable for:

• User-generated content accuracy
• Service interruptions due to technical issues
• Indirect or consequential damages
